Please can someone help?
My wife has been running 4 separate mobile phone contracts over the last 2 years
All required for her business.
All contracts have been paid on time via standing order with the bank.
These contracts have now finished however due to the fact the phones have been used constantly over the contract period they are showing there age.
So my wife ordered a new Nokia 6500 slide again on contract with THREE Network.
Upon arrival of her new phone she put her sim card in and tried to charge the phone.
Once the phone was fully charged she went out shopping etc on return home (some 3 hrs later) the phoned had switch itself off it required charging again We thought fine we must have not charged it long enough but this happened again.
So my wife called THREE and was speaking to someone for over 1hr trying to get the problem resolved they said we would be contacted back so we waited 2 days………My wife phoned them again this time it took 2 hrs to try to explain that the phone was faulty and that she would like to return the phone.
This is when the problem started they say once the phone has been personalised e.g. sim card inserted it is non returnable they have even admitted that Nokia have issue’s
With this phone regarding it not holding its charge.
My wife is disgusted Three blatantly sent her a broken phone, she has said she would like to send the phone back and cancel the new contract they say this is not possible she will have to honour her contract they insist she pays £30 first month rental or it
Will be passed over to a collective agency.
She ordered the phone on the 18/04/08 it arrived 22/04/08 so we have been trying since
Last week to resolve this but are getting no where my wife is worried that she will be black listed when it not her fault its making her ill
Can some help us?

We need to speak to someone in England the Indian call centre just pass us around from pillar to post we are desperate and for my wife’s health need a resolve to this nightmare company

Hi, welcome to Talk3G.

The phone was sent to you by post, yes? You have 14 days under distance selling regulations in which to return the handset. Unfortunately it looks like Three have messed you around long enough to miss that window.

Bear in mind that you also have a warranty with Nokia. If you wanted, you could get the handset repaired at a Nokia Repair Centre. However, I'm pretty sure that Three should have at least offered to repair the handset.

You/your wife must continue to pay the monthly fee until it has been confirmed as cancelled. It's not worth messing up your credit history over £30/month. If necessary, you could go to court to try and recover the costs later.
